Negative or adverse credit report always place us in our back foot. It creates different problems in getting fresh credit. So to protect the interest of the people the government has taken some legal steps. The Fair Credit Reporting Act favors the borrower in different ways. According to this act, the disputed elements from your credit report will be removed if the credit bureaus fail to verify it. According to this act you also have the right to update and amend the information mentioned in the credit report and if necessary you can place your side. Law is there, you have to utilize them. Always remember, the credit bureaus are not friends, so if you have dispute draw there notice and if possible take legal action.
To enforce the right of a borrower, there are six basic rights provided to him. The very first right says that you can challenge to any fact provided I the credit report which you think wrong. Secondly, it is the responsibility of the credit bureaus to investigate the matter without charging anything from you. Thirdly, the investigation of the credit bureau on any disputed matter must be concluded within a time frame of 30 days. Fourthly, it is the responsibility of the credit bureaus that if any item found untrue, it must delete it from your credit report. Fifthly, as a credit consumer you have the right to present your consumer statement containing your view regarding the problems and it is the responsibility of the credit bureaus to include your explanation in your credit report.

Methods to correct your credit report:

In the very beginning you have to encircle the errors you have spotted, and then copy every item that you have encircled. Secondly, write a letter to the credit agency that has compiled your credit report to draw its attention. Here you have to explain every item and ask the agency to correct it. You can attach the supporting document with your letter, but never send the originals. Thirdly, you should send the letter including supporting document by a certified mail to make sure that your complaint letter has reached at its destination. Fourthly, you should a similar letter to the credits explaining your causes.
After getting a dispute letter, the reporting agency will start an investigation and obviously verify the exact accuracy of the statement. After verification if the error is found, the agency will send the report with correct entry.
If you credit report has negative traits, you need to repair it. Now we shall discuss how to repair the negative credit reports. Firstly, you should collect the credit reports from three different agencies. You have to go through minutely the credit reports and identify troublesome records in the report.
Negative Credit Report

Credit report has an important bearing on our economic life. If you have a good credit report, you will get credit easily from your bank. But the credit report is not always favors us, sometime there are some negative elements are found which make the lender suspicious about the credit worthiness of the applicant. Therefore it is very much essential for us to know what exactly negative credit report is. The negative credit report reveals that you have not been able to meet your debt obligation; you have failed to pay the monthly installments timely. This negative credit report will push you back; you cannot bargain for lower rate of interest. Negative credit report always doesn’t mean that the lender will instantly deny you credit simply for your negative report, but he will have doubt on your credit worthiness.
The negative credit report doesn’t reveal your failure of debt obligation, it also tells about other information. The credit bureau that compiles the credit report, gathers such information while preparing the report. Information regarding criminal conviction, bankruptcy information, information about law suits etc also mentioned in this report. The credit agencies keep such negative information in most cases for seven years. However, there are some cases it stays there for longer period of time.
The negative credit report always downs the prospect of getting fair deal in the credit market. The information contained in your credit report is not open to all; such report is only provided to those people or organizations, which have legitimate business. The Federal Credit Reporting Act provides that only legitimate companies or organizations like insurance company, credit card Company, the employer with whom you are working or will work or the apartment owner. According to the provision the insurance company and credit consolidation company may send to you unsolicited offer. But you may remove your name from the list for which you have to maintain some formality. There is another credit law which want to protect the interest of the borrower which says that if an applicant is denied credit then he must be informed the reason for which his application is rejected. After getting report from the lender, if you find anything which is not true, you may sue the credit report agency. If you win the case, the credit reporting agency will pay the damage it has made. The debt problem in the USA is really complicated; it has many social and economic implications. Therefore, to protect the interest of the individual different provisions have been made.
Negative credit report (in Canada and USA) is very common and it can happen to any one. We have discussed earlier that negative or adverse credit report affects a borrower badly. If anything unwanted is mentioned in the credit report, we can remove it. If you have to go through minutely the moment you get your credit report. If anything wrong is found you have to underline it. Remember such negative items can be removed.

Sample Credit Report - details

Credit report is a document which gives the evidenc of your credit worthiness. It contains such information that reveals your habit of meeting debt obligation. Such report is essential both for the lender and borrower. If you are associated with the credit market then you must have sound knowledge on the subject so that yu can take right decision. As a lender, the credit report gives you enoguh indication whether to give an applicant a loan or not. As a borrower it enhances you confidence to get fresh loan from a lender. It is true for both indivudual and company or organization.
Credit report gives a deatil crdit histroy of a person or company. It contains different types of information from which a lender understands the credit worthness of the prospective borrower. The credit report contains usually four types of information regarding the borrower. Such information include identifying information, credit information, public record information and information of recent enqueries. Now we shall discuss what are these information and how such information guide a lender to decide whether to offer loan or not.
The identifying information of the credit report gives detail identification of the borower. The informations include the name, full address, social security numer, birth date and employment. From this information the lender can understand the genuineness of the borrower. The credit informatin mentioned in the credit record tells about the bank accounts, credit card issuing organization, credit limit, the date of oppening the accont and many other information relevant to the lender. The public eccord information tells about the court record especially about bankruptcy. In many occasions, reporting agencies also mention court record on non-monetary judgements. The infomatin of recent enquiries exactly tells how many persons have sought your credit report during the last two years.
The credit record becomes the base of the credi score. The credit score is nothing but the numerical expression of your credit worthiness. It is based on a deep analysis of the credit records of a borrower. This credit score is very much esential for the lender who is supposed to give you loan. The lender may be a bank or a creditcard company, which want to evaluatethe credit worthiness of the borrower. The lenders take this precaution to avoid bad debt. It ha been seen that a person with bad credit histroy often cannot met his credi obligation. The lenders decide the qualifying score for a borrower. In this regard there is no uniformity; differet banks and crdit card companies follow different standard in this regard.
The credit record or score is recently getting much importance. Its utility is not only limited to the banks and other financial institutions, curently it is used by many service providing cmpanies like insurnce company, telephone company, emplyoyers and diffrerent govement departments. In recent future, the credit score will be used by many other sectors. At present, this credit score has been a subject of interest for many academicians and researchers.
The credit scoring is generally controlled and regulated by the finacial svice authority and the customer has no knowledge regarding it. That means a borrower you cannot know his safe score to get a particular loan from a lender. Actually there is no safe score; it varies frombank to bank. Simply, the credit score is a complex thing to be deciphered by the borrower in advance. On the othr hand, the lnders also never disclose the method they use to select a prospective borrowr. No way, they disclose the munimum scrore required by them. From the above discussion it is clear that the borrwoer cannot take any precaution against low credit scoring. However, if the application of a borrower is declined by a lender, he is obliged to mention the reason.
The credit score is determined by different fiancial agencies in differetnt countries. In USA, it is determined by credit bureaus. There are three major credit bureaus in USA whch undertake this responsibility. The three major crdit bureaus which determine the credit score are Experian, TransUnion and Equifax. The calculation of credit score is not uniform, different bureaus may follow different methods for this. But one of the most recognized methods is FICO score. This is a special method of calculating credit score designed by Fair Isaac Corporation. This FICO score is recognised by many lenders through out the USA. The FICO score is worked out on a risk-based system which tells about the possibility of a borrower to default the debt obligation if loan is given to him. Apart this FICO score, each of the crdit bureaus has their own score. The Equifax is known for its ScorePower, while Experian and TransUnion sell PLUS score and Credit score respectively.
In USA, debt is a major problem. Many people incur debt but fail to meet their obligation. In such a situation, the citizens of USA can avail one free credit report from the above mentioned three credit bureaus in every twelve months. You can get the credit report from Annualcreditreport.com (this doesn’t not always work in Canada). If you want to know your credit report, you can log on this site to get your credit report. Remember that such credit report doesn’t furnish any credit scoring; if you want to know your credit score, you have to pay for it. There is a provision in some states like Colorado, California that a borrower is entitled to get his credit report if he is denied to get a loan.

Credit Scoring

The credit scoring is compiled by some specified credit agencies. Now the lenders like banks, financial organizations, credit card companies, debt consolidation companies buy such credit reports from the agencies. Such organizations are associated with lending business. On the basis of this report they will decide who is a good borrower. According to the provision of the fair Credit Reporting Act the credit scoring can be used by for other permissible purposes. Negative credit scoring affects negatively ones prospect of getting a fair deal from the lenders. If one gets loan, the rate of interest will be higher. That means the credit rating and rate of interest has inverse relation. If the credit rating is higher, the rate of interest will be lower for the borrower and the reverse will be if the credit rating is lower.

Good credit scoring or rating is also very useful in the matter of employment, insurance, housing, etc. Remember, all the lenders in the market do not follow the same standard. There is no cut off credit scoring below which a person will not get any loan. The lender decided at a particular scoring, which he feels safe to give loan to an applicant. The lender has the power of discretion to give loan to a particular borrower. In many occasions, the lender has to show causes or explain for which he is not offering loan to a particular applicant. The lender also provides the name and address of the credit reporting agency which has compiled the credit history and credit scoring.

How a Credit Score is Determined

A good credit score increases the prospect of a person to get loan from the lender, but a low credit score just does the reverse. Therefore, as a person associated with the debt market must have a sound knowledge on the subject. You must know, how the credit score is decided.

Credit scoring is decided by using mathematical logarithm. We do not have the scope to explain the detail process over here, but simply in this process a numerical value is assigned to every borrower. This numerical value will give an indication of a borrower’s creditworthiness and hence the lender decides on the basis of this credit scoring if he wants to give him the loan. In USA this scoring ranges in between 300 to 850. In USA all the credit bureau gives a credit scoring. It indicates that how one will be able to meet the credit obligation after taking loan.

Remember, higher credit scoring is good for both the parties. Late payments, troubled collection directly affect your credit scoring. Frequent entry in the public record also adversely affects the credit scoring. Similarly, if the lender seeks your credit score it affects negatively your credit scoring. More enquiries from the side of the lender affect your credit scoring adversely.

How Credit History is Compiled

If you are associated with the credit market, then it is very much necessary for you to know about the process of compilation of credit history. In the USA, the credit history of the consumers is compiled by some specific agencies. Such agencies are known as credit rating agencies. The credit rating is popularly known as credit bureaus or consumer reporting agencies. It is the responsibility of the agency to compile the personal credit history of different consumers. For this the necessary data are provided by different creditors. Such data contain all relevant information like detail records of transaction, payment history and credit limit. It also gives information about if any action has been taken earlier by the lender to recover the debt.

When, a borrower approaches to a lender for a fresh loan, the lender will go through such information and asses the position of the borrower and then he will take decision if loan can be issued to the borrower or not. But in many occasions, the lender finds increasingly difficulty in understanding the true position of the borrower from the credit report. So to make the process more easy and effective, a system of credit score is used now a day. If your credit score is higher, the lender will be willing to give your fresh loan easily. So credit scoring has an important bearing both for the lender and borrower.
